Point Details
Law / office Patents Act, 1970 (Rules amended 2024) • Indian Patent Office
Fee — individual / startup / MSME ₹1,600 (e-filing, up to 30 pages & 10 claims)
Fee — large entity ₹8,000
Request for Examination (Form 18) Mandatory — within 31 months (filings on/after 15 Mar 2024)
Term 20 years from the date of filing
Expedited exam (Form 18A) Available to startups/MSMEs — grant in ~1–2 years
Process: Patentability search → file (provisional or complete) → complete spec within 12 months of provisional → publication at 18 months → Request for Examination → First Examination Report → response → grant. Renewal fees apply annually from the 3rd year. Startups (DPIIT) get up to 80% lower fees and free facilitator support under SIPP.

What Goes Wrong If You Delay / Miss Steps
Lost priority
Not filing the complete spec within 12 months abandons the application.
Deemed withdrawn
Missing the 31-month examination request permanently withdraws the application.
Patent lapses
Missing annual renewal from year 3 makes the patent unenforceable.
